Preamble
Entering into any transaction with our company implies acceptance by our clients of our General Terms and Conditions of Sale and current pricing, which override any conflicting document.
All disputes, regardless of their nature, shall be submitted to the Commercial Court of Fréjus, which shall have exclusive jurisdiction, even in the event of multiple defendants or third-party claims.
Information & departures
• Departure and arrival: Old Port of Saint-Raphaël, Port of Agay or Fréjus.
Your boarding port will necessarily be your disembarkation port.
• Tickets are valid for a specific date.
• Reservation is mandatory for all cruises, on-site, by phone or on the website: www.taksea.fr
On board
* Large bulky bags are not allowed; backpacks and handbags are permitted
* Cameras and personal belongings (not too bulky) are allowed
* TAKSEA declines all responsibility in case of damage, breakage, loss or theft
* Please remember sunscreen and a hat
* Life jackets are provided
* Drinks are provided during the trip
* Prohibited for children under 5 years old except in case of private booking
* Activity not recommended for pregnant women and people with back problems
* Unfortunately, the activity is not accessible to persons with reduced mobility
* Masks and snorkels are provided, but swimming and exploring the seabed remain optional and under your own responsibility
Prices
Our tickets are always invoiced according to the VAT rate in force in mainland France at the time of purchase. Prices are inclusive of all taxes. Prices may be modified. An invoice may be issued after payment.

Delay, modification, cancellation
TakSea reserves the right, without prior notice, to cancel an excursion or modify its schedule (weather conditions, technical issues).
In case of cancellation on our part, you will be fully refunded.
In case of delay, we will wait a maximum of 10 minutes. No refund will be granted for delays exceeding 10 minutes.
In case of low attendance (fewer than 6 tickets sold for the excursion), we reserve the right to cancel the trip.
Cancellation/modification by the customer is free up to 72 hours before departure. No refund will be issued within 72 hours of departure.
Retention of title clause
It is expressly agreed that our tickets remain our property until full payment of the sale price.
Any contrary clause shall be deemed null and void. If tickets have been delivered, our company reserves the right to reclaim them in accordance with law n° 85-98 of January 25, 1985. Until full payment, tickets remain under the responsibility of the purchaser, who must bear all risks, whatever their cause, including force majeure or third-party actions.
In the event that our tickets are transformed or resold, we expressly reserve the right to claim the corresponding payment.
Termination clause
In case of non-payment, even partial, of issued tickets, we reserve the right to demand immediate payment of all amounts due.
In such cases, or in the event of changes in the debtor’s situation (incapacity, company modification or dissolution, risk for any reason), the agreement may be terminated at our initiative, in whole or in part, by simple notification sent by registered letter, without further formality and without prejudice to damages.
If we do not invoke this clause, we reserve the right to request guarantees to ensure the execution of ongoing agreements.
Acknowledgment and acceptance of risks
The passenger acknowledges having been informed of the risks inherent to the navigation activities offered by the operator, including: injuries during boarding or disembarkation, sunstroke, seasickness, back or spinal injuries caused by waves, burns, stings from jellyfish or sea urchins, cuts from rocks during swimming, or exposure to pathogens.
He/she agrees to follow the safety instructions given by the captain during the briefing before departure.
He/she declares, for themselves and for any persons under their responsibility or for whom they purchase tickets, that they have no specific health issues (back problems, osteopathic conditions, pregnancy beyond 3 months, etc.), or agrees to inform the captain in advance. The captain reserves the right to refuse boarding if necessary.
It is reminded that our terms and conditions prohibit access to our boats for pregnant women beyond 3 months and for persons suffering from back problems or osteoporosis.
Due to the nature of the navigation activities, regardless of precautions taken, the French Tourism Code, Transport Code, or Athens Convention cannot be enforced against TEAM YACHTING.
The passenger waives any claim relating to bodily or material damage concerning items carried or worn.
In case of emergency, the passenger authorizes SARL Team Yachting to provide first aid and to decide, including at the passenger’s expense, to transport them to an appropriate medical facility if necessary.
This waiver applies regardless of the contractual basis invoked and regardless of the representative of the operator or its staff.
